To be honest, you can't really blame them. It is trademarked and even their ad slogan! But beyond that, if they don't show that they have tried to protect their trademark they could lose it so it's probably just them doing that.

But on the other hand, it's unfortunate that they don't see the value in having people join in on the fun. There are some really smart companies out there that realize the potential and let their customers do stuff like that and then there are others that are, well, stupid. That would rather sue their customers rather than build relationships.

I still think it's a decent idea and some people might find it cute. Throw it up on a different domains...milkstashes.com? milkmoustaches.com? milkylips.com? I don't know if any of those are available but just to show you you can do it on a non-trademarked domain. Then all you have to worry about is being confused with some kind of porn site lol.

Don't worry, that's just a cease and desist - not a law suit. If it was a law suit you would have been subpoenaed to a court date. You shouldn't try to fight them if they own the trademark, because they can get a judgment against you if they take it to trial which would probably include damages and attorney's fees. Honestly though, they're getting kinda picky about making you take that site down. It's non commercial at this point.

What's Up Caesar & Nick?
